Terms of Service

1. Who this agreement is with

"NBM," "we," "us" means Now Booked Marketing. "You" means the person or organization that signs up for an account. Using the service means you agree to these Terms.

2. Account and access

You are responsible for keeping your credentials safe and for any activity that happens under your organization. Add team members through the in-app invite flow so we can track who did what.

3. Billing

Plans are billed monthly in advance. Upgrades take effect immediately; downgrades take effect at the next billing cycle. If a charge fails, we will retry a few times before pausing service. Refunds are handled case-by-case for good-faith requests within the first 14 days.

4. Your data and content

You own everything you put into the platform: customer records, agreements, site copy, campaign assets, everything. We hold a limited license only to store, process, and display it as required to operate the service. You can export or delete your data at any time from the admin panel; the actual purge completes within 30 days.

5. Acceptable use

Don't use the service to:

• Send unsolicited bulk messages that violate CAN-SPAM, TCPA, GDPR, or CASL.
• Impersonate a person or business you don't represent.
• Attempt to break, reverse-engineer, or bypass rate limits.
• Scrape competitors' sites in a way that violates their terms.
• Store data you don't have the right to store (customer PII you didn't collect, etc).

We reserve the right to suspend an account we believe is abusing the platform. We'll try to reach you first.

6. AI-generated content

Parts of the platform draft copy, emails, and code using large language models. The drafts are suggestions. You are responsible for reviewing and approving anything sent to a customer or published to a live site.

7. Third-party services

The platform integrates with services like GoHighLevel, Resend, Stripe, Convex, Vercel, and Anthropic. Your data flows to these providers as needed. Their terms and privacy policies apply to whatever data reaches them. We publish a full subprocessor list on request.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind. We don't guarantee that AI drafts will be accurate, that the service will be uninterrupted, or that stored data can never be lost. We keep backups and monitor uptime, but you should keep your own copies of anything critical.

9. Limits of liability

To the fullest extent allowed by law, our total liability for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim.

10. Changes and termination

We may update these Terms. Material changes will be announced with at least 30 days' notice by email. You can close your account at any time from the admin panel. We can close accounts that violate these Terms or that stay unpaid past two billing cycles.
